A legal malpractice suit brought by a neophyte real estate developer was correctly thrown out, based on a rule that restricts claims for lost profits by a new business, a New Jersey appeals court has ruled.

No error was made when a Monmouth County judge dismissed a malpractice suit against Cooper Levenson and an ex-partner of the firm after excluding damages testimony under the new-business rule, the Appellate Division said Monday.
