Should lawyers go into great detail in explaining an arbitration provision in a retainer agreement to clients in order for it to be enforceable?

In Delaney v. Dickey, a unanimous New Jersey Supreme Court affirmed the Appellate Division’s holding that attorneys have such an obligation, given their fiduciary responsibilities to clients and the Rules of Professional Conduct imposed on them to act accordingly.
