A Monmouth County Superior Court judge has rejected prosecutors’ attempt to disqualify a criminal defense lawyer—a bid premised on contact between the lawyer and her client’s alleged victim.

The judge rejected the motion to disqualify attorney Tara Breslow from representing Fred Tuzzolino on charges of stalking, because Breslow is not a necessary witness. Any information Breslow could provide in testimony could be obtained elsewhere, Judge Lourdes Lucas found Tuesday.
