BlueTriton Brands and Niagara Bottling LLC were hit with a class action Tuesday in New Jersey District Court over the labeling of plastic water bottles. The suit accuses the defendants, which manufacture and sell water brands including Arrowhead, Deer Park, Poland Spring, Niagara and Costco Kirkland, of making false and misleading claims that their single-use plastic bottles are 100% recyclable. Bursor & Fisher filed the suit on behalf of a putative class of New Jersey consumers. Counsel have not yet appeared for the defendants. The case is 3:21-cv-13904, Haggerty v. Bluetriton Brands, Inc. et al.
