In Libertarians for Transparent Government v. Cumberland County, attorneys for each side argued before the New Jersey Supreme Court on whether a settlement agreement between a county government and a former employee resolving an internal disciplinary action against the employee is considered a government record—and not a personnel file—under Section 10 of the Open Public Records Act.

The case involved a former corrections officer who admitted having sexual relations with at least two incarcerated women, and was later allowed to retire with a pension while the county said it had terminated him.
