When Is a Volunteer Not a Volunteer?

Employment LawFacts: Kimberly Goulding was employed, Monday through Friday, as a cook and cooking teacher at Friendship House, a non-profit organization that helped build the skills of persons with developmental disabilities, including autism. On Saturday, Sept. 23, 2017, Friendship House held, on its property, the first of what was intended to be an annual "Family Fun Day" for its clients and families. Friendship's employees were asked, but not required, to volunteer to work the event. Kim volunteered to work the event as a cook, her normal week-day job. While preparing for lunch at the event, Kim stepped into a pot hole in the parking lot and injured her ankle, which required surgery.
