From the beginning and throughout the pandemic, we have supported all reasonable government measures to contain, mitigate and end the horrific impacts of COVID-19. That has included compassionate release of prisoners, eviction relief, modification of court procedures and the allowance of employer vaccination mandates. Some of those measures have imposed substantial burdens and infringed on rights, but we have recognized the adjustments and even sacrifices that this public health crisis has required us to make.

The Occupational Health and Safety Administration’s (OSHA’s) recent Emergency Temporary Standard (ETS) is a monumental step toward achieving high vaccination rates and diminishing the spread of COVID-19. The ETS imposes substantial burdens on employers of 100 or more employees, including the establishment of a mandatory vaccination policy or a policy requiring unvaccinated employees to be tested for COVID-19 on a weekly basis. It will impose a burden on many workers by putting them in the position of choosing between vaccination and unemployment. But the policy it seeks to advance is one we wholeheartedly endorse: vaccinate as many people as soon as possible.
