A federal appeals court has ruled against Philadelphia’s ban on flavored tobacco products, holding that the city’s ordinance—geared toward preventing minors from using tobacco—is superseded by state law.

The U.S. Court of Appeals for the Third Circuit upheld a lower court’s grant of an injunction filed by tobacco companies suing the city for the alleged loss of revenue caused by the ban on flavored tobacco.
