A $340 million settlement by Old Navy LLC illustrates that retailers remain vulnerable to deceptive pricing suits, even as some courts have soured on that cause of action.

Judge Ethan Schulman of the Superior Court of California in San Francisco granted final approval Thursday to the Old Navy settlement, which also provides an additional $3.75 million for attorney fees and costs, attorneys said. The suit resolves claims that the company advertised goods with an original price and a reduced price, but never made any sales at the original price.
