The same New Jersey Appellate Division panel on Monday tackled two separate cases involving the enforceability of arbitration agreements in pre-injury releases, resulting in one win and one loss for trampoline park chain Sky Zone.

In Perez v. Sky Zone, Louie Perez visited Sky Zone in Springfield, New Jersey with his seven-year-old son. Upon arrival, he checked in at a kiosk where he was presented with a participation agreement containing an arbitration provision. Perez checked the box indicating he agreed to arbitration, which stated he was waiving his right to bring a lawsuit against Sky Zone and would instead participate in arbitration if any claims arose, according to the Appellate Division’s opinion.
