A legal malpractice suit concerning a municipal attorney’s eligibility for health benefits can proceed, after an appeals court ruled the case had been wrongly dismissed for being beyond the statute of limitations.

The Borough of Manville sued Francis Linnus, its solicitor from 2008 to 2014, after state officials said he was illegally enrolled in a state-operated health benefits program.
