The New Jersey Supreme Court, in a 5-1 decision, has upheld the “residency exemption” from Jersey City’s 1% payroll tax.

Jersey City Ordinance 18-133 taxes employers at a rate of 1% of their entire payroll to fund public education in the city, but includes an exemption under which the tax does not apply to employees who reside in the city.
