With the adoption of the Personal Use Cannabis Rules, N.J.A.C. 17:30-1.1, et seq., New Jersey has embarked on regulating a recreational adult-use cannabis market and joins a growing number of states and countries that have welcomed cannabis entrepreneurs and businesses. Starting a new business in a new, highly regulated industry is never easy or without risk, uncertainty, and obstacles. For business enthusiasts looking to plant a flag in New Jersey, a long onerous process awaits. Regardless of the license category or type sought, applications must be submitted via the Cannabis Regulatory Commission’s (CRC) online portal. See https://www.nj.gov/cannabis/businesses/. Before beginning the application process, applicants need to determine what license class and type they are going to pursue.

Currently, the CRC is only accepting applications for:

  • Class 1 Cultivators, who grow and harvest marijuana;
  • Class 2 Manufacturers, who process marijuana into finished goods and oils;
  • Class 5 Retailers, who sell marijuana products to consumers; and
  • Testing laboratories.
