The New Jersey Appellate Division vacated an arbitration award for two Kean University professors who had been reassigned to nonteaching duties, agreeing with the school that the award was not “reasonably debatable.”

According to the opinion, Kean appealed an arbitration decision in favor of the Council of New Jersey State College Locals, AFT, AFL-CIO. The union grievance was filed in response to the reassignment of two tenured professors from teaching to curriculum development in response to falling enrollment in their departments, Art History and Music. Kean responded with a scope of negotiations petition to restrain arbitration and argued that the reassignment was based on an educational policy decision.
