The New Jersey Appellate Division reversed three trial court motions granting leave to file late notice of a tort claim in cases involving employees who contracted COVID-19 while working at the Hudson County Correctional Facility.

Two corrections officers and a nurse working at the correctional facility contracted COVID-19 in the early days of the pandemic. The three appeals brought by Hudson County, the Hudson County Correctional Center, and three individuals named in the suits asserted an abuse of discretion by the trial court in granting the plaintiffs’ motions for leave to file a late notice of tort claim for extraordinary circumstances.
