A judge in Mercer County, New Jersey, approved a $6.6 million settlement and up to $2.2 million in counsel fees in a class action against telecommunications provider RCN Telecom Services.

The settlement was reached after the plaintiffs steered the case clear of mandatory arbitration clauses for some of the class members, according to lead class counsel Stephen DeNittis of DeNittis Osefchen Prince in Marlton, New Jersey. After the case was removed to federal court and settlement terms were reached over several months, the parties agreed to stay the federal case and refile in state court because that was seen as yielding a speedier approval than in federal court, DeNittis said.
