"A judge of the Appellate Division, the Hon. Jose L. Fuentes, is temporarily assigned to the Court to fill one of those vacancies," stated Rabner. "Jose Fuentes is scheduled to retire on September 1, 2022, which will leave the court without a quorum for the start of the 2022-2023 term."

The case, filed Oct. 2 in Massachusetts District Court by the Brown Law Firm on behalf of Stephen Austen, accuses certain officers and directors of misleading investors in regard to Symbotic's potential for margin growth by failing to disclose that the company was not equipped to timely deploy its systems or manage expenses through project delays.
