In the Alex Jones InfoWars defamation lawsuits, the recent plaintiffs' verdict is a significant milestone in the development of modern First Amendment jurisprudence.
As is well known, First Amendment protection does not extend to various types of false speech, such as fraudulent misrepresentation, perjury, and defamation. A claim of defamation requires proof of a published statement of fact (not pure opinion), that is false and unprivileged, and that causes injury to another's reputation, resulting in harm to a person's emotional, physical, and/or financial wellbeing.
