The Appellate Division has upheld the disqualification of an attorney over his representation of both a police lieutenant and the internal affairs officer who conducted an investigation into disciplinary charges leveled against that lieutenant.

When an Englewood Police Lieutenant, Fred Pulice, became the subject of an internal affairs investigation, he hired attorney Albert Wunsch, according to the opinion. Another lieutenant, Herman Savage, reported to Englewood Chief of Police Lawrence Suffern that Pulice had fallen asleep on duty on two occasions. Suffern referred those allegations to the EPD Internal Affairs Unit for investigation, according to the opinion.
