Expungement applications are supposed to be heard quickly. By statute, New Jersey courts must hold a hearing no more than 60 days after the expungement application is filed. And the application may be granted without a hearing if no objection is filed.

Reports from attorneys around the state tell a different story. Even before COVID, expungement applications were routinely ignored for months. Since COVID, delays routinely exceed a year.
