The U.S. Court of Appeals for the Third Circuit has, for the second time, affirmed a district court decision to toss out a legal malpractice action against Toms River-based Horn Law Group, this time finding that the plaintiff failed to prove that he would have prevailed in the probate action but for defendants’ alleged conduct.

The winning defendant, attorney Jeff Horn, said the case highlighted the importance of malpractice insurance for small firm practitioners.
