In a published decision, the New Jersey Appellate Division held that a trial judge appropriately considered the privacy interests of an attorney-plaintiff in allowing limited discovery of her private social media posts and cellphone bills to defend against her claims that she was terminated in violation of the state's Law Against Discrimination.

According to the opinion, Norma Davis was fired as a senior staff attorney with Disability Rights New Jersey in January 2020 by Gwen Orlowski and Ellen Catanese. Davis filed a complaint against Disability Rights, Orlowski, and Catanese that alleged she was let go due to her need for disability accommodations for her lupus condition and cancer diagnosis.
