E.I. du Pont de Nemours prevailed over a southern New Jersey resident’s motion to remand his personal injury claim back to state court in a suit that alleged the ”improper disposal, use, and discharge” of PFAS and other materials caused his leukemia, sinus tumors, and other damages.

Giuseppe “Joseph” Curiale first filed suit in Salem County Superior Court in Curiale v. A. Clemente, on Dec. 6, 2022. In his complaint, Curiale seeks to recover damages for “alleged improper disposal, use, and discharge of ‘toxic and dangerous chemicals and substances’ including ‘poly- and perfluoroalkyl substances (PFAS), dioxins, furan, lead, mercury, arsenic, and polycyclic aromated hydrocarbons (PAHs).”
