The Appellate Division reversed an order denying the New Jersey Policemen’s Benevolent Association’s request for attorney fees and costs against Simon Law Group brought under Rule 1:4-8 and the Frivolous Litigation Statute.

The New Jersey Policemen’s Benevolent Association operates a Legal Protect Plan (LPP) that reimburses a specified amount of attorney fees for its members. The reimbursement is for a maximum hourly rate of $130 for a maximum of $1,000 for an internal affairs investigation and $3,500 for a criminal investigation, according to the opinion filed Aug. 21.
