An attorney for former President Donald Trump recently appeared on network television to discuss the role the U.S. Supreme Court could play in reviewing the decision of the Supreme Court of Colorado barring Trump from the primary ballot in Colorado under the “insurrectionist” clause of the Fourteenth Amendment.

The attorney, who is licensed and practices in New Jersey, spoke directly to how Justice Brett Kavanaugh might view the case: “You know people like Kavanaugh, who the president fought for, who the president went through hell to get into place, he’ll step up. … These people will step up not because they’re pro-Trump but because they’re pro-law. Because they’re pro-fairness and the law on this is very clear.”
