New Jersey joined two amicus briefs this week supporting the Food and Drug Administration in the U.S. Supreme Court case of FDA v. Alliance for Hippocratic Medicine, in which the court granted petitions for review a Fifth Circuit opinion restricting distribution of the medication mifepristone.

The underlying dispute centers around a lawsuit filed by the anti-abortion group Alliance for Hippocratic Medicine, which claimed that the FDA’s original approval of the drug in 2000, and subsequent actions expanding access to the drug, were illegal. The group, which is being represented by the conservative Christian legal advocacy group Alliance Defending Freedom and Erin Morrow Hawley, was incorporated in 2022 in Amarillo, Texas, where the lawsuit was filed.
