New Jersey Attorney General Matthew J. Plakin proposed a new rule clarifying prohibitions against disparate impact discrimination under the state’s Law Against Discrimination and provides examples of policies and practices that negatively impact protected classes.

The proposed rule, issued by Platkin and the state’s Division on Civil Rights, codifies existing state and federal case law. The proposed rule was published in the New Jersey Register and will be subject to a notice-and-comment period through Aug. 2. Comments may be submitted to [email protected].
