The U.S. Court of Appeals for the Third Circuit rejected a challenge mounted by several New Jersey staffing agencies against the Temporary Workers’ Bill of Rights, which took issue with a pay requirement that aligns workers’ wages with that of permanent employees performing similar work at a client company.

A group of staffing agencies, including the New Jersey Staffing Alliance, the American Staffing Association and the New Jersey Business and Industry Association, filed suit against the acting director of the New Jersey Division of Consumer Affairs in the Department of Law and Public Safety, Cari Fais, and other state defendants.
