Last September, we spoke of the number of automobile accidents in New Jersey and nationwide caused by drivers distracted by handheld cellphone usage was "staggering." The National Highway Traffic Safety Administration reports that use of handheld cellphones while driving continues to be a leading cause of injury and death on the highway.

In our state, the penalty for using a handheld cellphone while driving is a fine of between $200 and $400 for a first offense, between $400 and $600 for a second offense and between $600 and $800 for a third offense, together with a potential 90-day license suspension plus three points on the driving record. There are exceptions to penalties for handheld use of cellphones for emergency situations requiring calls to the police, medical providers, fire departments or other emergency services.
