At oral arguments before the New Jersey Supreme Court on Monday, state prosecutors fought to include expert testimony on shaken baby syndrome at trial.

Two fathers, Darryl Nieves and Michael Cifelli, are facing charges in Middlesex County Superior Court for aggravated assault and child endangerment. In both cases, the trial court judges barred the admission of testimony the state tried to admit, which alleged that shaking alone can cause injuries associated with shaken baby syndrome or abusive head trauma, also referred to as SBS/AHT.
