The New Jersey Supreme Court is set to consider whether a municipality must pay close to $200,000 in sanctions under the Frivolous Litigation Statute to its former attorneys, some of whom hale from a top New Jersey Law firm.

The state high court on Wednesday granted certification to Englewood Cliffs in a case filed against their former attorneys that touches on an area the Appellate Division called “unsettled law” concerning the Frivolous Litigation Statute. The high court's order in Englewood Cliffs v. Trautner means the justices are now set to address whether a municipality is subject to sanctions for filing a frivolous lawsuit under the Frivolous Litigation Statute.
