The U.S. Court of Appeals for the Third Circuit held that the New Jersey statute legalizing marijuana and preventing employers from refusing to hire users, does not provide a private remedy for employment discrimination claims.

On Tuesday the court split 2-1 on the question, with Judge Peter J. Phipps penning the majority opinion, which said the plaintiff’s two claims rely on different legal theories based on the rescission of the job offer based on a positive drug test.
