(per curiam) (7 pp.) In this action for legal fees, in which defendant filed a third-party complaint for legal malpractice, the Appellate Divisions holds that the parties’ attempt to circumvent the interlocutory jurisdiction rules by agreement between the parties to a voluntary dismissal without prejudice so that the appeal of the dismissal of the third-party complaint could proceed cannot stand and the appeal is dismissed as interlocutory.
