Ford Motor Company appeals the certification of a class of Ford dealers in this action alleging that Ford’s Blue Oval Program violated the Robinson-Patman Act, the Automobile Dealer’s Day in Court Act, and numerous state franchise laws, and alleging breach of contract and the covenant of good faith and fair dealing.

The Blue Oval Program was created to improve dealer performance and customer satisfaction. It provided cash bonus payments and other benefits to Ford dealers who improved customer satisfaction according to certain criteria.
