The Justice Is In — Merck & Co. Inc. seems to have succeeded in a move to ensure that state Supreme Court Justice Roberto Rivera-Soto, who sided with the company in previous cases involving arthritis painkiller Vioxx, is on the panel hearing the next significant Vioxx appeal.
In two Vioxx cases on other issues already heard, Rivera-Soto voted with the majorities that handed Merck significant victories.
