Habitats of animals that are not endangered but are threatened with endangerment are within the state’s environmental protection powers, a N.J. appeals court says in a ruling that may have wide ramifications for builders.
Monday’s ruling upholds the Department of Environmental Protection’s denial of a wetlands development permit for a Cape May County tract said to be a habitat of the barred owl, which the state has found to be a “threatened” species.
