05-2-2600 Atlantic County Municipal Joint Insurance Fund v. Green, App. Div. (per curiam) (5 pp.) Peter Romanelli received workers’ compensation benefits through the Atlantic County Municipal Joint Insurance Fund (JIF) following a car accident that occurred when he was acting within the scope of his duties as a police officer. JIF, as Romanelli’s subrogee, filed suit against defendant, the other driver, for reimbursement of the workers’ compensation benefits. Defendant’s insurance was subject to the verbal threshold. Agreeing with Judge Nugent that allowing workers’ compensation carriers to bring claims that could not be maintained by the injured driver would undercut the rationale of AICRA, the appellate panel affirmed summary judgment in favor of defendant.
