ARBITRATION AND MEDIATION — ALTERNATIVE PROCEDURE FOR DISPUTE RESOLUTION ACT
03-2-2906 DIA of Jersey City et al. v. Fogari et al. , App. Div. (per curiam) (19 pp.) This matter arises out of a business dispute that the trial court, with the parties’ consent, referred to a private umpire pursuant to the Alternative Procedure for Dispute Resolution Act (APDRA). The umpire issued an award, ruling in part for plaintiffs and in part for defendants. The trial court sustained the umpire’s findings and entered a final judgment. The parties each appealed. Because of certain unresolved issues that were omitted from the umpire’s disposition, the appellate panel affirmed the judgment in part, vacated it in part and remanded for further proceedings. [Decided Feb. 27, 2009.]
