(10 pp.) In this action against three of plaintiff’s former partners alleging that they helped defendant-firm raid it of attorneys and staff and “steal” its bankruptcy department, which ultimately led to its destruction, defendant-firm’s motion seeking partial summary judgment is denied. The trial judge finds that the voluntary withdrawal of the claims against one of the individual defendants did not collaterally estop plaintiff from proceeding against defendant-firm and recommends that the firm’s motion for leave to appeal be denied.
