The state Supreme Court on Tuesday declined to widen a loophole in the American Rule, which generally requires litigants to bear their own legal fees.
The “third-party exception” allows a litigant who must bring or defend an action against a third person as a result of another person’s tort to recover legal fees from the tortfeasor as an additional element of damages.
