R.L. v. Voytac, A-61 September Term 2008; Supreme Court; opinion by Wallace Jr., J.; decided June 11, 2009. On certification to the Appellate Division, 402 N.J. Super. 392 (2008). DDS No. 36-1-4135 [33 pp.]

At issue is the interpretation of the statute of limitations provision of the Child Sexual Abuse Act (the Act). The Act provides that an action for child sexual abuse shall be brought within two years after the “reasonable discovery of the injury and its causal relationship to the act of sexual abuse.” The Act also provides for a tolling of the statute of limitations because of “the plaintiff’s mental state, duress by the defendant, or any other equitable grounds.”
