01-2-5481 I/M/O Walker, App. Div. (per curiam) (16 pp.) The Merit System Board’s denial of petitioner’s request for Sick Leave Injury benefits pursuant to N.J.S.A. 11A:6-8 and N.J.A.C. 4A:6-1.6 is affirmed since, inter alia, the board’s finding that petitioner, who was injured while in the restroom, was “on break” and thus not engaged in a work-related activity, rendering her ineligible for SLI benefits, was not arbitrary or capricious, and she failed to provide evidence that she was not “on break” when injured or that she was required by her employer to remain at her work station, which would have made her eligible for SLI benefits under an exception in N.J.A.C. 4A:6-1.6(e)(2).
