This case involves the assignment of roofing work in the construction of Egg Harbor Township’s community center. The township required that all parties participating in the construction project be signatories to a project labor agreement (PLA), which the township adopted as authorized by state law. Sambe Construction Company was the general contractor on the project and a signatory to the PLA. Sambe subcontracted to defendant E.P. Donnelly Inc. the work of installing prefabricated standing seam metal roofing, soffit, fascia and related trim. Donnelly, as part of its deal with Sambe, signed a letter of assent binding it to the PLA, and agreeing that any party to which it subcontracted work would likewise be required to assent to the PLA.
