Boylan v. The Borough of Point Pleasant, A-0234-08T2; Appellate Division; opinion by Skillman, P.J.A.D.; decided and approved for publication December 4, 2009. Before Judges Skillman, Fuentes and Simonelli. On appeal from the Chancery Division, Ocean County, C-319-02. DDS No. 34-2-6064 [12 pp.]

This title dispute involves one of 63 lots of shore property that was subdivided in 1920. The subdivision map depicted the eastern boundary of the oceanfront lots as a straight line and gave precise measurements for the lot lines. The land beyond the eastern boundary was described as “beach.” Plaintiffs’ lot, lot 1 in block 9, borders the ocean. In dispute is a 75-foot wide area that the borough is presently using as part of its municipal beach.
