A recent interpretation of New Jersey’s affidavit of merit statute has eased the mandate, and rightfully so, for obtaining an expert where the defendant is a board-certified doctor.
The issue in Barunas v. Hunterdon Medical Center , HNT-L-333-08, decided by Hunterdon County Superior Court Judge Peter Buchsbaum in an unpublished opinion on Oct. 23, centered on the plaintiff’s difficulty in getting an expert as required by the statute, N.J.S.A. 2A:53A-41.
