A property owner’s half-century use of a neighbor’s lagoon demonstrates that a grant of riparian rights was not extinguished during a brief period when the two tracts came under common ownership, the Appellate Division ruled Wednesday.
As a result, the owner of a man-made lagoon with navigable access to Great Egg Harbor Bay must allow an upstream owner to extend his dock into the waterway for swimming, fishing and boating uses, the court said in McAdams v. Dagit Bros. Holding Co., A-5139-07.
