An appeals court on Wednesday threw out a $1.2 million whistleblower verdict and a $523,000 fee award, holding the plaintiff was not entitled to damages because he was not terminated or constructively discharged.
Applying precedents construing the Law Against Discrimination to a claim under the Conscientious Employee Protection Act, the Appellate Division held the trial judge erred in denying a motion for judgment notwithstanding the verdict.
