The state Supreme Court is deciding how much slack a plaintiff’s lawyer in a medical malpractice action should get when he tries, but fails, to comply with the stricter standards set for an expert under the 2004 amendments to the Affidavit of Merit Statute.
A lawyer representing a woman, Abby Ryan, who sustained a perforated bowel during a colonoscopy three years ago asked the Court on Tuesday to overturn an Appellate Division ruling dismissing the claim against the board certified gastroenterologist, Dr. Andrew Renny.
