Superior Court Judge Mary Thurber will have to answer for alleged malpractice and excessiveness of fees charged as a lawyer, now that a suit by her former clients has been reinstated.

A trial court dismissed the suit, Higgins v. Thurber, A-0108-08, on procedural grounds, but the Appellate Division on Wednesday said “it would be unfair and unjust to bar the legal malpractice claim in these circumstances.”
