Mayer v. Belichick, No. 09-2237; Third Circuit; opinion by Cowen, U.S.C.J.; filed May 19, 2010. Before Judges Fisher, Cowen and Pratter, District Judge, sitting by designation. On appeal from the District of New Jersey. [Sat below: Judge Brown.] DDS No. 11-8-7948 [25 pp.]

Plaintiff Carl Mayer appeals from the District Court order granting the motions to dismiss filed by defendants Bill Belichick and the New England Patriots as well as by defendant National Football League (NFL). This case was filed by Mayer, a New Jersey resident and New York Jets season ticket-holder, in response to the so-called Spygate scandal that arose when it was discovered that the Patriots were surreptitiously videotaping the signals of their opponents.
